DEFINITIONS
Airline Designator Code means two characters or three letters which identify particular air carriers. Air Moldova Designator code is 9U.
Authorized Agent means a sales agent who has been appointed by Carrier to represent Carrier in the sale of air passenger transportation over the service of the Carrier.
Baggage - all articles intended for passenger use. Unless otherwise specified, it includes both checked and unchecked baggage.
Baggage Check means those portions of the ticket, which relate to the carriage of the passenger's checked baggage.
Baggage Tag means a document issued solely for identification of Checked Baggage.
Carrier includes Air Moldova and the air carrier, other than Air Moldova, issuing the ticket and all air carriers that carry the passenger and/or his baggage there under or undertake to perform any other services related to such air carriage.
Checked Baggage - Baggage for which we take sole custody and for which we have issued a Baggage Tag.
Check-in Deadline - time limit specified by the airline by which a Passenger must have completed check-in formalities and received his boarding pass.
Code Share - carriage by air which will be operated by another carrier as indicated in the ticket.For passengers who will be traveling on an itinerary operated by one of Air Moldova’s Code Share partners, please see Article 2.3 that may differ from the rules described in this rule.
Conditions of Contract means those statements contained in, or delivered with, the ticket, which include a reference to some of these General Conditions of Carriage and notice.
Conjunction Ticket means a ticket issued to a passenger in conjunction with another ticket, which together constitute a single contract of carriage.
Convention - the Convention for unification of certain rules for international carriage by air which was agreed 28 May 1999 in Montreal (Montreal Convention).
Damage - includes death, wounding, or bodily injury to a Passenger, loss, partial loss, theft or other damage, arising out of or in connection with carriage or other services incidental thereto performed by the Carrier.
Electronic flight coupon - electronic flight coupon or other value document held in Carrier’s database.
Electronic Ticket – Itinerary Receipt issued by the Carrier or on its behalf, the Electronic Coupons and, if applicable, a boarding document.
The European Union (EU) - an economic and political union of 28 member states – Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom and Croatia.
Flight coupon - means both a paper Flight Coupon and an Electronic Coupon, each of which entitles a Passenger to travel on the particular flight identified on it.
Flight Segment indicates the particular places between which Passenger is entitled to be carried.
Force Majeure - unusual and unforeseeable circumstances beyond Carrier’s control, the consequences of which could not have been avoided even if all due care had been exercised.
Normal Fare means published fare approved for carriage in a given class of carriage.
Passenger means any person, except members of the crew, carried or to be carried in an aircraft pursuant to a ticket.
Passenger with Reduced Mobility (PRM) - any person whose mobility is reduced due to physical incapacity, an intellectual deficiency, age, illness or any other cause of disability when using transport and who require individual attention and/or assistance, which normally are not given to other Passengers.
Special Fare means the fare which is lower than the normal fare.
Stopover means a deliberate interruption of the journey by the passenger at a point between the place of departure and the place of destination.
Tariff means the published fares, charges and/or related conditions of carriage of an airline filed, where required, with the appropriate authorities.
Ticket means the document entitled "Passenger Ticket and Baggage Check" issued by or on behalf of Carrier and includes the Conditions of Contract, notices and Coupons.
Unchecked Baggage means any baggage of the Passenger other than checked baggage.
1. APPLICABILITY
1.1 General
1.1.1 These General Conditions of Carriage are the conditions of carriage of Air Moldova referred to in the ticket and, except as provided in paragraph 1.3 of this Article, apply to all carriage of Passengers and baggage only on those flights, or flight segments, where Air Moldova is designated as the carrier for that flight segment.
1.2 Charter Operations
1.2.1 If carriage is performed pursuant to a charter agreement, these Conditions of Carriage apply also to charter flight as far as the Conditions of Carriage are not in conflict with Charter agreement.
1.3 Code Share flights
1.3.1 On some routes Air Moldova offers its services together with other air carriers, under arrangements known as „Code Shares". This means that even if a Passenger has a reservation with Air Moldova and holds a ticket where Air Moldova name or airline designator code (9U) is indicated as the carrier, another carrier may operate the aircraft. If for a Code Share flight Air Moldova is indicated as the carrier, these Conditions of Carriage also apply to such transportation.
If such arrangements apply Air Moldova will advise the Passenger of the carrier operating the aircraft at the time he makes a reservation.
1.3.2 For Code Share services on flights operated by another carrier, Air Moldova is responsible for the entirety of the Code Share journey for all obligations to Passengers established in these rules.
1.3.3 However, each Code Share partner has its own rules with respect to the operation of its flights, which may differ from Air Moldova’s rules for flights operated by Air Moldova. Those rules are incorporated herein by reference and form a part of these Conditions of Carriage.
1.3.4 The rules with respect to operations that may differ between Air Moldova and its Code Share partners include, but not limited to:
- Check-in time limits;
- Unaccompanied minors;
- Carriage of animals;
- Refusal to transport;
- Oxygen service;
- Irregular operations;
- Denied boarding compensation;
- Baggage acceptance, allowance and liability.
1.3.5 For the rules and regulations of Code Share partners Air Moldova recommends to Passengers to visit Code Share partners’ official web - sites or to contact their travel agencies.
1.3.6 The Carrier is aware how important it is for a Passenger to know the carrier he is actually flying with, Air Moldova will advise the Passenger of the carrier operating the aircraft at the time he makes a reservation.
1.3.7 Regarding a reservation made through a channel which is not under the direct control of Air Moldova, i.e. travel and online agencies, those travel/online agencies are obliged to inform passengers at the time of reservation regarding the identity of the operating carrier and of each change of the operating carrier respectively.
1.4 Overriding Law
1.4.1 These Conditions of Carriage are applicable unless they are inconsistent with Carrier's Tariffs or applicable law, in which event such Tariffs or laws shall prevail. If any provision of these Conditions of Carriage is invalid under any applicable law, the other provisions shall nevertheless remain valid.
1.5 Conditions Prevail over Regulations
1.5.1 Except as provided in these Conditions of Carriage, in the event of inconsistency between these Conditions of Carriage and any other regulations of Air Moldova, dealing with particular subjects, these Conditions of Carriage shall prevail.
2. TICKETS
2.1 General Provisions
2.1.1 Air Moldova will provide carriage only to the Passenger named in the Ticket and on its presentation, in case of paper ticket, of the flight coupon and all consecutive flight coupons.
In case of electronic ticket, Passenger’s itinerary receipt must be presented. Passenger may also be required to provide appropriate identification card or passport with viza if it is required by the country of destination.
2.2 Ticket is not transferable
2.2.1 Some Tickets are sold at discounted fares, which may be partially or completely non-refundable. For the individual terms please refer to the respective tariff conditions. Passengers should choose the fare best suited to their needs.
2.2.2 The Ticket is and remains at all times the property of the issuing Carrier.
The ticket constitutes prime evidence of the Contract of Carriage between Airline and the passenger. The Conditions of Contract contained in the ticket are a summary of the provisions of these Conditions of Carriage.
2.3 Requirement for Ticket
2.3.1 Except the case of an Electronic Ticket, a Passenger shall not be entitled to be carried on a flight without presentation of a valid Ticket issued on Passenger’s name containing the Flight Coupon for that flight and all other unused Flight Coupons. Passenger shall not be entitled to be carried if the presented Ticket is mutilated or if it has been issued otherwise than by the Carrier or Carrier’s Authorized Agents. In case of Electronic Ticket, Passenger shall not be entitled to be carried on a flight without providing valid personal identification documents.
2.4 Loss of Ticket
2.4.1 In case of loss, theft or mutilation of a ticket (or part thereof) by the passenger, upon the passenger's request Carrier will replace such ticket (or part of it) by issuing a new ticket, provided there is evidence, readily ascertainable at the time, that a ticket valid for the flight(s) in question was duly issued and provided that the passenger signs an agreement to reimburse Carrier for any costs and losses, up to the value of the original ticket, which are incurred by Carrier for misuse of the ticket. The Carrier will charge a non-refundable amount for issuance of duplicate Ticket.
Not applicable in case of electronic ticket.
2.5 Passenger’s Name
2.5.1 Transportation will be provided to the Passenger, whose name is introduced in the ticket. The name on the ticket must be identical to that on the passport and all other documents required for the trip. Carrier reserves the right to verify passenger’s travel documents.
2.6 Period of Ticket validity
2.6.1 Except as otherwise provided in the ticket, these Conditions, or in applicable tariffs (which may limit the validity of ticket, in which case the limitation will be shown on the Ticket), a ticket is valid for:
a) one year from the date of issue, in case of completely unused Ticket;
b) one year from the first travel under the Ticket, in case of partially used Ticket.
2.7 Coupon Sequence and Use
2.7.1 The Passenger’s Ticket is valid only for the transportation as shown on the Ticket, from the point of departure via any agreed stopping points to the final destination. The fare paid is based upon the Tariff and is valid for the transportation as shown on the Ticket. Terms and conditions are the main part of the contract between the Carrier and the Passenger. The Ticket will not be honored and will lose its validity if all the Coupons are not used in the sequence provided in the Ticket.
2.7.2 In case the Passenger changes his transportation without Carrier’s agreement, the Carrier will assess the correct price for the actual travel.
2.7.3 Please be aware that many fares are valid only on the dates and for the flights shown on the Ticket and may not be changed at all, or only upon payment of an additional fee.
2.7.4 Each flight coupon will be accepted for carriage in the class of service specified therein on the date and flight for which space has been reserved.
2.7.5 In particular the ticket does not entitle the Passenger to commence his journey at any of the specified stopover points if the first coupon for an international flight has not in fact been used for transportation.
2.8 Name and Address of the Carrier
2.8.1 Carrier's name may be abbreviated in the ticket. The address of Air Moldova Company: Dacia bd. 80 ⁄ 2, Airport, MD 2026, Chisinau, Republic of Moldova.
3. FARES, TAXES, FEES AND CHARGES
3.1 Fares
3.1.1 Fares apply only for carriage from the airport at the point of origin to the airport to the point of destination, unless otherwise expressly stated. Fares do not include ground transport service between airports and between airports and town terminals. The fare will be calculated in accordance with our Tariff in effect on the date of payment of Passenger’s ticket for travel on the specific dates and itinerary shown on it. In case the Passenger changes his itinerary or travel dates, this may impact the fare to be recalculated.
3.2 Taxes, Fees and Charges
Applicable taxes, fees and charges imposed by Government or other authority, or by the operator of an airport, shall be payable by the Passenger. At the time of Ticket purchase, the Passenger will be informed about the taxes, fees and charges not included in the fare, most of which will normally be shown separately on the Ticket. The taxes, fees and charges imposed on air travel are constantly changing and can be imposed after the date of Ticket issuance. If there is an increase in a tax, fee or charge shown on the Ticket, the Passenger will be obliged to pay it. Likewise, if a new tax, fee or charge is imposed even after the Ticket issuance, the Passenger will be obliged to pay it.
The Carrier is not liable for any supplements for services connected to the issuance of ticket and its reissuance that may be requested by its agents or servants (such as travel agents)
3.3 Currency
Fares, taxes, fees and charges are to be paid in the currency of the country in which the ticket is issued, unless another currency is indicated by the Carrier.
4. RESERVATION
4.1 Reservation Requirements
4.1.1. The Carrier or its Authorized Agent will record Passenger’s reservation(s). Upon request of the Passenger Carrier will give him a written confirmation of the reservation (s).
4.1.2. Certain fares may have conditions which limit or exclude the passenger's right to change or cancel reservations.
4.2 Ticketing Time Limit
4.2.1. Carrier may cancel a reservation without notice if a Passenger has not paid for the ticket prior to the specified ticketing time limit, as advised by Carrier or its authorized agent.
4.3 Personal Data
4.3.1 Passenger recognizes that personal data has been given to Carrier for the purposes of making a reservation, purchasing a ticket, obtaining ancillary services, facilitating immigration and entry procedures and making available such data to government agencies, in connection with his travel. Carrier is further authorized to transmit such data for such purposes to its own offices, its authorized agents, other carriers, the providers of ancillary services or government authorities, in whatever country they may be located.
In accordance with Article L 237 -7 of French Homeland Security Code, please be informed that air carriers may transmit reservation, checking and boarding data collected from their passengers ( API/PNR) to the French national public services and competent authorities for the purposes and under conditions as defined in the Decret N° 2014-1095 dated 26/09/2014, modified by decree 2018/714 dated August 3rd 2018
4.3.2 The passenger gives his/her consent to personal data processing by the carrier.
4.4 No particular Seat Guaranteed
4.4.1 Air Moldova does not honor advance seating requests and cannot guarantee any particular seat. The Carrier reserves the right to assign or reassign seats at any time, even after boarding. This may be necessary for operational, safety or security reasons.
Carrier will endeavor to honor advance preferred seating assignments on its official web-site only (www.airmoldova.md), this service is available 24 hours before the flight. In case when an aircraft change occurs or an aircraft with a configuration different from the one available at booking time, Air Moldova reserves the right to modify Passenger’s seat selection initially chosen at booking time.
4.5 Reconfirmation of Reservations
4.5.1 Air Moldova does not require reconfirmation of reservations. If other carriers require the Passenger to reconfirm onward or return reservations, failure to comply with any such requirement will entitle the carriers to cancel the onward or return reservation.
4.5.2 Passenger should check the reconfirmation requirements of any other Carrier involved in his journey with them. Where it is required, the passenger must reconfirm with the Carrier whose code appears for the flight in question on the ticket.
4.6 Cancellation of Onward Reservations
4.6.1 If a Passenger does not show up for a flight, without advising Carrier in advance, Carrier may cancel onward and/or return reservations.
5. CHECK-IN AND BOARDING
5.1 On all Air Moldova flights the check-in is open 3 hours before departure time and is closed strictly 60 minutes before scheduled time of departure. It is important for the Passenger to allow himself ample time to comply with Check-in Deadline. The Carrier reserves the right to cancel passenger’s reservation if the Passenger does not comply with the Check-in Deadline indicated.
5.2 Passenger shall arrive at Carrier's check-in location and boarding gate not later than the time that will be indicated by Carrier in passenger’s boarding pass, in order to permit completion of any departure formalities sufficiently in advance of flight departure. For all Air Moldova flights, the gate closes 25 minutes prior to departure. At Frankfurt airport the gate closes 30 minutes prior to departure.
5.3 If the Passenger fails to arrive in time at Carrier's check-in location or boarding gate Carrier is entitled to cancel the space reserved for the Passenger and will not delay the flight. Carrier will not be liable to the Passenger for loss or expense due to failure of the Passenger to comply with the provisions of this Article.

6. RIGHT TO REFUSE CARRIAGE/SPECIAL ASSISTANCE
6.1 Right to refuse carriage
6.1.1 The Carrier may refuse to carry the passenger or his baggage if one or more of the following have occurred or if Carrier reasonably believes may occur:
- Passenger has not paid the applicable fare, taxes, fees or charges;
- Passenger does not respect our regulations or has refused to submit to a security check;
- Passenger does not appear to have valid travel documents, may seek to enter a country through which he may transit, or for which he does not have valid travel documents, destroy his travel documents during the flight or refuse to surrender his travel documents to the flight crew, against receipt, when requested;
- Passenger has committed misconduct on a previous flight, and the Carrier has reasons to believe that such conduct may be repeated;
- Passenger’s conduct, age, or mental or physical state, including impairment from alcohol or drugs, present a hazard or risk to himself, to passengers, to crew, to company’s employees or property;
- Such action is necessary in order to comply with any applicable government laws, regulations or orders governing flights from, into or over individual countries;
- The carriage of Passenger or his baggage may endanger or affect the safety, health or materially affect the comfort of other passengers or crew;
- Passenger has the interdiction of entering a specific country and Carrier has the proper notification from the immigration authorities of that country regarding this interdiction;
- Passenger presents a ticket that has been acquired unlawfully, has been purchased from an entity other than Carrier or its Authorized Agent, has been purchased or obtained in breach of the Air Moldova Club membership terms and conditions, or that has been reported as being lost or stolen, is a counterfeit, or if the person presenting the ticket cannot prove that he is the person named in the "NAME OF PASSENGER";
- Passenger has failed to comply with the requirements concerning coupon sequence and use;
- Passenger fails to observe Carriers instructions with respect to safety or security;
- Passenger fails to observe the non-smoking rule or prohibited use of electronic equipment on board;
- Passenger requires special assistance which cannot be provided by the Carrier respecting all safety rules.

6.2 Special Assistance
Carriage of unaccompanied children, incapacitated persons, pregnant women, and persons with illness or other people requiring special assistance shall only be performed subject to Carrier's prior consent, minimum 72 hours before flight. Such passengers shall not be subsequently refused carriage on the basis of such disability and/or special requirements.
Acceptance for carriage of unaccompanied children, incapacitated persons, pregnant women, and persons requiring special assistance is subject to Carrier’s approval in accordance with its regulations available on official web - site www.airmoldova.md. Passengers should inform the Carrier about their disability or any other needs for special assistance and any special devices they will carry and which they depend on (e.g. wheelchair, crutches, etc.).

6.3 Passengers with reduced mobility (PRM)
Acceptance of Passengers with reduced mobility is based on Carrier’s ability to provide such service, passengers’ health status, and limitations per aircraft type and is subject to prior arrangements.
In certain cases the Carrier may request a medical certificate with regard to health state of the Passenger and his fitness for flight. When medical certificate is required, MEDIF form also must be filled in by the treating physician and sent to the airline medical service for clearance and approval.
You must be confident that you are medically fit to fly and that your health condition is appropriate to use our services. It is your responsibility to ensure that all precautions, such as but not limited to medical advice/ use of needed medication, are taken before the flight, if necessary.
The Carrier may also request the Passenger to travel with an attendant if it is essential for his safety or if the Passenger is unable to understand safety instructions during evacuation from the aircraft.
Passengers with reduced mobility travelling with their own wheelchair must inform the Carrier at time of reservation about the type of wheelchair or mobility device, as due to safety reasons some types of battery operated wheelchairs (with spill able and lithium battery) cannot be accepted as checked baggage. The transport of one piece of mobility equipment (wheelchair, crutches, other mobility aids) per person with reduced mobility is free of charge.
6.4 Children/Unaccompanied Children
An Infant is one who has not yet reached his/her second birthday. If the Infant has crossed his/her second birthday when the journey commences, then the ticket would have to be issued with a part infant and part child fare. Infants are accepted on fight only accompanied by an adult (one infant per adult).
A child is one who has reached his/her second birthday but not yet reached his/her twelfths birthday on the date of commencement of journey. Children are accepted on flight only accompanied by an adult. Unaccompanied minor service may be provided if the child is at the age of 5 and over.
The carriage of unaccompanied minors requires prior arrangement with the Carrier, minimum 72 hours before the flight. Applicable UMNR fee will be paid before or during the check-in.
The „unaccompanied minor” procedure must be applied for all children between 5 and 12 years old travelling alone, regardless the citizenship. The „unaccompanied minor” procedure may be applied for unaccompanied minors aged between 12 and 18 years old and travelling alone, on special request of the parents or appointed guardian.
The carriage of minors travelling without their parents or legal guardians is subject to a supplementary check of the laws or rules of the residence country of the minor. It is solely the responsibility of parents or legal guardians to arrange and provide all requested documents for their children’s travel in special in case of their double citizenship or residence. If the requested documents are not provided, all subsequent fines imposed against the airline have to be paid by the parents or appointed guardian.
According to the Moldovan Legislation and Immigration Authorities requirements, minor citizens of the Republic of Moldova, must be accompanied at least by one parent, tutor or any other adult who shall be appointed by notary legalized declaration of one of the parents/tutors, when travelling abroad the RM.
The „unaccompanied minor” procedure must be applied for all Moldovan citizens between 5 and 18 years old when departing from the Republic of Moldova, provided all requested documents. The “unaccompanied minor” procedure will be applied for Moldovan citizens between 12 -18 years old travelling to Republic of Moldova upon prior request only.
6.5 Expectant Mothers
Air Moldova accepts carriage of expectant mothers by providing the medical certificate which states clearly fitness for travel starting with 28th until the end of 32nd pregnancy week. Beyond the end of 32nd till the end of 35th pregnancy week and in cases of complicated pregnancy, the passenger must present a medical certificate, which states clearly fitness for travel and a MEDIF form completed by attending physician and confirmed by airline doctor prior to departure day.
Expectant mothers can be accepted on board before the end of 35th week of pregnancy and expectant mothers before the end of 32nd week of pregnancy only in case of multiple (twins) uncomplicated pregnancy.

7. BAGGAGE
7.1 Free Baggage Allowance
7.1.1 Air Moldova company applies Piece Concept policy for baggage transportation. Free baggage allowance is applied according to the fare rules.
7.1.2 The Free Baggage Allowance corresponds to carriage of a quantity of baggage per Passenger limited by number and/or weight and/or dimensions, determined on the basis of the Tariff and appearing on the Ticket.
7.1.3 Air Moldova will not accept baggage whose size, weight, or character makes it unsuitable for transportation on the aircraft. No article will be accepted as baggage if it weights more than 32 kg or has a total outside dimension (length plus width plus height) of more than 203 cm.
7.1.4 Baggage weighting more than 32 kg must be either repacked into more pieces weighing up to 32 kg or has to be sent as cargo. Special baggage items such as wheelchairs, musical instruments and large sport equipment are excluded from this rule.
Standard baggage weight is 23 kg; summary dimensions are 158 cm.
7.1.5 For flights with Air Moldova designator code operated by another carrier (Code Share) the free baggage allowance is indicated on the ticket; excess baggage fees are subject to the operating carrier’s terms and conditions. These rates are available from the operating carrier or the travel agency which issued the Ticket.
7.1.6 One collapsible stroller, pushchair or carrying basket is allowed free of charge for infants.
7.1.7 One wheelchair/mobility aid per passenger is permitted on Air Moldova aircraft. Wheelchairs/mobility aids will NOT be transported if it exhibits evidence of previous leakage or damage.
7.2 Excess Baggage
7.2.1. Passenger will be required to pay a charge for carriage of baggage in excess of the free baggage allowance. These rates are available on Air Moldova official web-site www.airmoldova.md.
7.2.2 For Code Share flights excess baggage fees are subject to the operating carrier’s terms and conditions.
7.3 Items Unacceptable as Baggage
7.3.1 Items which are likely to endanger the aircraft or persons or property on board the aircraft, such as those specified in the ICAO or IATA Dangerous Goods Regulations and in Air Moldova regulations which are available from its representatives on request.
7.3.2 Dangerous goods are articles or substances which are capable of posing a risk to health, safety, property or the environment. Special regulations are applicable for the transport of these goods.
For safety reasons do not carry dangerous goods, such as those listed below, in all your baggage and on your person:
- explosives and ammunition (detonators and fuses, blasting caps, smoke generated cartridges, dynamite, gunpowder and plastic explosives, mines, grenades and other explosives military stores, replicas or imitation explosive devices);
- fireworks and other pyrotechnics, flares;
- safe boxes/boxes incorporating goods such as lithium batteries or pyrotechnics
- irritating or offensive materials;
- compressed gases (e.g. butane, propane, lighter fuel, oxygen);
- corrosive materials (e.g. acids, alkalis, mercury, batteries);
- flammable solids (e.g. matches and articles that are easily ignited)
- flammable liquids (e.g. acetone, fuel, industrial alcohol over 70% );
- poisons (e.g. arsenic, cyanide, insecticide);
- radioactive materials;
- oxidizing materials (e.g. bleach, nitrates, peroxide);
- radioactive materials;
- weapons and firearms ;
- electroshock weapon (e.g tasers);
- disabling devices;
- any other material presenting a hazard not covered above such as magnetized, offensive or irritating.
7.3.3 Items the carriage of which is prohibited by the applicable laws, regulations or orders of any state to be flown from or to.
7.3.4 Items which are reasonably considered by the Carrier to be unsuitable for carriage because they are dangerous, unsafe or by reason of their weight, size, shape or character, or which are fragile or perishable having regarded to, among other things, the type of aircraft being used. Information about unacceptable items is available upon request.
7.3.5 Transportation of firearms and ammunition (whether real, replica or toy) by passengers and crew members is forbidden on Air Moldova flights. Transportation of the firearms is allowed only for the following categories of passengers: bodyguards, escorts and law enforcement officers, who perform their duty of service in order to assure the security of the state officials; accompany the special cargo and diplomatic cargo/mail; escort a person under arrest. Further information is available from Air Moldova upon request.
7.3.6 Passenger’s Obligations:
- Passengers declare that they are fully aware of the content of their Baggage;
- Passengers undertake not to leave their Baggage unattended from the moment they pack it and not to accept items from strangers;
- Passengers undertake not to travel with Baggage entrusted to them by a third party;
- Passengers are advised not to include perishable or fragile items in their Baggage. If however the Passenger includes such items or objects in their Baggage, they must ensure that these are properly and securely packed and protected in suitable containers in order not to damage these items and objects.

7.4 Right to Refuse Carriage of Baggage
7.4.1 The Carrier will refuse to carry as baggage the items described in 7.3, and may refuse further carriage of any such items upon discovery.
7.4.2 The Carrier may refuse to carry as baggage any item reasonably considered to be unsuitable for carriage which is likely to endanger the aircraft, persons or property; likely to be damaged by air carriage, unsuitably packed, forbidden by Dangerous Goods Regulations; forbidden by any applicable laws, regulations or orders of any State to be carried from, into or over; unsuitable for air carriage due to its weight, size or nature.
7.4.3 The Carrier may refuse to accept Baggage for carriage unless it is properly and securely packed in suitable containers.

7.5 Right of Search
7.5.1 For reasons of safety and security Air Moldova may request passenger’s agreement for a search and scan of his person and a search, scan of his baggage. If passenger is not available, his baggage may be searched in his absence for the purpose of determining whether passenger is in possession of or whether passenger’s baggage contains any item described in 7.3.
7.5.2 The following rules apply for security baggage screening:
- Checked baggage and carry - on baggage are screened by an electronic device;
- If no electronic device is available a physical search must be performed;
- Baggage security screening is performed by local airport authorities;
- The baggage in hold and cabin baggage must be screened or searched prior to passengers being allowed into security restricted areas and board the aircraft. If any item is unsuitable for carriage by air it should be retained and removed.
7.5.3 If the passenger is unwilling to comply with such request, Carrier may refuse to carry the passenger and baggage. In the event a search or other scan causes damage to the passenger or his baggage, Carrier shall not be liable for such damage except in case of willful misconduct or gross negligence.
7.5.4 Passenger must allow security checks of his baggage by government officials, airport officials, police or military officials and Carriers involved in his carriage.
7.6 Checked Baggage
7.6.1 Upon delivery to Carrier of baggage to be checked, Carrier shall take custody thereof. Carrier will thereupon make an appropriate entry on the ticket for record. Baggage identification tags that may be issued by the Carrier in addition to the baggage check are for identification purposes only.
7.6.2 Checked Baggage must have Passenger’s name or other personal identification affixed to it.
7.6.3 Checked Baggage will, whenever possible, be carried on the same aircraft as Passenger, unless the Carrier decides for safety, security or operational reasons to carry it on an alternative flight.
If Passenger’s Checked Baggage is carried on a subsequent flight the Carrier will deliver it to Passenger, unless applicable law requires Passenger to be present for customs clearance.
7.6.4 The Passenger must ensure that his Checked Baggage is sufficiently robust and adequately packed; it is closed and well secured to withstand the conditions of carriage by air without sustaining damage.
7.6.5 The Carrier is not be liable for loss, damage or delay in delivery of items described below, which are included in Passenger’s checked baggage, with or without Carrier’s knowledge:
- fragile or perishable articles;
- medicines;
- money, credit cards, checks;
- jewelry, precious metals;
- business documents, negotiable papers;
- electronic equipment, computers, phones;
- securities and keys;
- documents, passport and other identification documents;
- samples.
7.6.6 Other Items prohibited in checked baggage:
- e-cigarettes;
- spare batteries;
- any perishable products and products of animal origin: meat, fish, milk or fresh by-product.
7.6.7 Restriction on carriage Electronic Cigarettes in checked baggage:
- It is strictly forbidden to transport electronic cigarettes in checked baggage;
- Electronic-cigarettes must be carried only in carry-on baggage;
- It is forbidden to use it on board of aircraft or during the flight.
7.6.8 Restrictions on Carrying Lithium Batteries on Aircraft.
Whether a battery can be carried or not depends on its type, configuration, the quantity and power of the battery (Wh rate for lithium ion battery and lithium content in grams for lithium metal battery):
- Spare lithium batteries are NOT PERMITTED to be carried in checked-in baggage and must be carried only in cabin baggage. All lithium batteries must be removed from carry-on baggage if such baggage cannot be accommodated in the aircraft cabin.
The batteries must be protected from short circuit by taping over the exposed terminals, or by placing it in a separate protective case or strong plastic bag. Spare batteries must not come in contact with metal objects, coins, keys.
- Lithium batteries installed in equipment may be carried in checked-in baggage. Carry- on baggage is recommended.
All battery powered devices must be switched off and measures must be taken to ensure that they cannot be accidentally activated when placed in checked baggage (by taping the activation switch). Devices must not be charged while on board of the aircraft.
- Damaged or recalled batteries including those contained in equipment are forbidden for transportation.
- Small electric vehicles powered by lithium batteries like air wheels, solo wheels, hover boards, mini-seaways’, balance wheels, e-bike are not permitted for transportation in baggage.

7.6.9 Samsung Galaxy Note 7 Alert
In light of recent incidents and concerns raised by Samsung about its Galaxy Note 7 devices, EASA strongly advises passengers to carry these devices only in carry-on baggage and not to turn on or charge these devices on board aircraft.
7.7 Transportation of Special Baggage
7.7.1 Transportation of Special Baggage such as sport equipment, musical instruments, bulky items or any other baggage items that may need special handling or approach during the fight will only be accepted for carriage in the cabin or cargo compartment if the Passenger has given the Carrier notice in advance and has received its confirmation. Special charge must be paid for this service.

7.8 Unchecked Baggage
The carry-on bag must be able to fit comfortably in an overhead bin or under the seat in front of Passenger, so as to not obstruct the evacuation process during an emergency.
Baggage exceeding the above limitations will be handled as a checked bag. An additional fee may apply if the Passenger is over the number and weight allotment granted for check-in.
7.8.1 The airline may specify maximum dimensions, weight and allowance for the unchecked baggage which you carry on to the aircraft cabin. The airline declines any responsibility for loss or damage to hand luggage.
7.8.2 If Passenger’s unchecked baggage cannot be stored in this manner, or is excessive in weight, dimensions and number of pieces or is considered unsuitable for transportation in cabin, it must be carried as Checked Baggage.
7.8.3 Maximum dimensions for unchecked baggage are 115 cm (50x40x25cm). Business class passengers may carry two pieces of unchecked baggage, maximum weight of the first piece not exceeding 8 kg and of the second piece– 4 kg. Economy class passengers may carry one piece of unchecked baggage maximum weight of which must not exceed 8 kg.
7.8.4 The Carrier may refuse to carry unchecked baggage, which is in excess to the specified dimensions or size or number of pieces or which is likely to endanger the aircraft, persons or property; or unsuitably packed or forbidden by any applicable laws, regulations or orders of any state to be carried from, into or over.

7.8.6 Detailed description on items prohibited in hand baggage:
- guns, firearms or other devices that discharge projectiles, including:
- firearms of all types, such as pistols, revolvers, rifles, shotguns;
- toy guns, replicas and imitation firearms capable of being mistaken for real weapons;
- component parts of firearms, excluding telescopic sights;
- compressed air or CO2 guns, such as pistols, pellet guns, rifles and ball bearing guns;
- signal flare pistols and starter pistols;
- bows, cross bows and arrows;
- harpoon guns and spear guns;
- slingshots and catapultas.
- stunning/ paralyzing effect devices, including:
- devices for shocking, such as stun guns, tasers and stun batons;
- animal stunners and animal killers;

7.9 Delivery of Checked Baggage
7.9.1 The Passenger is required to collect his Checked Baggage as soon as it is available at the destination or stopover.
7.9.2 If a Passenger does not collect Baggage within three months from the Baggage being made available to him, the Carrier may dispose of Passenger’s Baggage, without being liable to the Passenger in any way.
7.9.3 The Carrier shall deliver checked baggage to the bearer of the baggage check upon payment of all unpaid sums due to us under the Contract of Carriage.
7.9.4 If a person claiming the baggage is unable to produce the baggage check and identify the baggage by means of a baggage identification tag, Carrier may deliver the baggage to such person on condition that he establishes to Carrier's satisfaction his right thereto, and if required by Carrier, such person shall furnish adequate security to indemnify Carrier for any loss, damage or expense which may be incurred by Carrier as a result of such delivery.
7.10 Pets and Assistance dogs
Air Moldova gladly accepts small cats and dogs in the aircraft cabin. These pets must not be dangerous or offensive to other passengers. Air Moldova does not accept pets of any kind as checked baggage or as cargo.
It is highly recommended that the pet container be soft sided, however, hard sided containers may be used as long as it complies with the hard sided container measurements: 50X40X25 cm (length x width x height). Maximum weight of container including pet should not exceed 8 kg.
Any pet brought onboard must be in a pet container and meet the following criteria:
- be enclosed and allow room for the pet to stand, sit, breathe, and rest comfortably;
- be easy to open, strong enough to withstand the stress of flying, and free of objects that could injure the pet;
- have a leak proof bottom and be well ventilated.
Pets must remain in the container during the entire flight. The container must remain under the seat in front of the Passenger during taxi, takeoff and landing.
7.10.1 The animals shall be properly crated and accompanied by valid health/vaccination certificates, entry permits, and other documents required by the countries of entry or transit. The Carrier reserves the right to determine the manner of carriage and to limit the number of pets which may be carried on a flight.
7.10.2 Carriage of animals may be subject to additional conditions and limitations and the Carrier reserves the right to limit the destinations on which animals may be accepted as well as the number of animals which may be carried on a flight. The weight of accompanied pets including the weight of containers shall not be included in the free baggage allowance of the Passenger and an additional charge shall be paid by the Passenger.
7.10.3 The Carrier is not responsible for injury or loss, sickness or death of an animal, before, during or after the flight.
7.10.4 The Carrier will have no liability and decline all responsibility in respect of any such animal not having all the necessary exit, entry, health documentations and any other necessary documents with respect to the animal's entry into or passage through any country, state or territory and the person carrying the animal must reimburse any fines, costs, losses or liabilities reasonably imposed or incurred by the Carrier as a result.
7.10.5 Due to special conditions for live animals’ transportation Air Moldova will not accept live animals on flights for transportation to/from United Kingdom and to/from Ireland.
7.10.6 Assistance dogs or guide dogs accompanying a passenger with a disability are accepted for transportation in the passenger cabin free of charge upon receiving our prior approval (72 hours before a flight). Safety related limits in weight and size do apply. If necessary an extra seat shall be blocked for safety reason and comfort. If the Passenger travels with a service animal, he should notify the Carrier about it at time of reservation and should be able to prove the animal’s status as “service animal” by written documentation - such as a certificate, identification card, by presence of harness, verbal assurance.
The Passenger is responsible for all necessary documents for the import/export or transit of the animal. The service dog must be properly harnessed, muzzled but need not to be caged. It is not allowed to move around in the cabin and must not occupy a seat. The Carrier will have no liability in respect of any such animal not having all the necessary documents for entry into or passage through any country. The Passenger is liable for all damages which the animal might cause to others.

8. SCHEDULES, DELAYS, CANCELLATION OF FLIGHT, DENIED BOARDING
8.1 Schedules
8.1.1 The flight times shown in timetables may change between the date of publication and the date Passenger actually travel. Times shown in timetables or elsewhere are not guaranteed and form no part of this contract.
8.1.2 If the Passenger provides the Carrier with the correct contact information, the Carrier will notify the Passenger of any schedule changes. If, after Ticket purchase, the Carrier makes significant changes in the scheduled flight time, which is not acceptable to the Passenger, Carrier shall, at the Passenger's option, either: rebook the flight for the next one, reroute the flight or refund the ticket without any additional charge.
8.1.3 The airline will take all necessary measures to avoid delay in carrying the Passenger and his baggage. In the exercise of these measures and in order to prevent a flight cancellation, in exceptional circumstances the Carrier may arrange for a flight to be operated on its behalf by an alternative carrier and/or aircraft.

As under the Montreal Convention, airline’s obligations should be limited or excluded in cases where an event has been caused by extraordinary circumstances which could not have been avoided even if all reasonable measures had been taken. Such circumstances may, in particular, occur in cases of political instability, meteorological conditions incompatible with the operation of the flight concerned, security risks, unexpected flight safety shortcomings and strikes that affect the operation of an operating air carrier.
8.1.4 Except as otherwise provided by the Montreal Convention, if the Carrier cancels a flight, fails to operate a flight reasonably according to the schedule, fails to stop at Passenger’s destination, is unable to provide previously confirmed space or cause the Passenger to miss a connecting flight on which he holds a confirmed reservation, the Carrier shall:
- carry the Passenger at the earliest opportunity on another of its scheduled services on which space is available without additional charge and, where necessary, extend the validity of Passenger’s Ticket; or
- within a reasonable period of time reroute the flight to the destination shown on Passenger’s Ticket by Carrier’s own services or those of another carrier in the same class of transportation without additional charge.
8.1.5 We will offer the options outlined in Article 8.1.4 (a,b) only in cases described below:
- if the flight cannot be operated due any reason other than force-majeure reason;
- if boarding is denied due any reason other than government requisition of overall or part of the aircraft capacity;
- only if Passenger does not refuse to undergo a security check or to obey the lawful instructions and regulations of Air Moldova;
- If boarding is denied due reasons other than due to following Passengers’ conditions:
If Passenger’s conduct, age or mental/physical state may cause discomfort or/and health risk to himself or any person; or if the Passenger is under the influence of alcohol or drugs; or if the Passenger is believed to be actively contagious or communicable; if the Passenger appears not to have valid travel documents; if the Passenger has presented a ticket that is damaged or obtained illegally, or has been declared lost or stolen; or the person that presents the ticket cannot reasonably prove that he/she is the same person in name of which that ticket was issued;
- only if Passenger has a confirmed reservation on the flight concerned;
- only if Passenger (except in case of cancellation) is on time for check-in;
- only if Passenger travels with the ticket bought at a fare available to the public;
- if boarding is denied due to overbooking only.
8.2 Flight delays, cancellation, denied boarding
8.2.1 We strive to the best of our abilities to avoid cancellations, flight delays and denied boarding due to overbooking. If Passenger’s flight is cancelled or is subject to a delay, or if the Passenger is denied boarding on a flight for which he holds a valid reservation, the Passenger is entitled to certain rights disclosed herein. As under the Convention, the Carrier’s obligations should be limited or excluded in cases where an event has been caused by extraordinary circumstances which could not have been avoided even if all reasonable measures had been taken. Such circumstances may, in particular, occur in cases of political instability, meteorological conditions incompatible with the operation of the flight concerned, security risks, unexpected flight safety shortcomings and strikes that affect the operation of an operating air carrier.
8.2.2 Air Moldova Company applies the Regulation:
- to Passengers who have a confirmed reservation on the flight concerned;
- to Passengers who (except in case of cancellation) present themselves in time for check-in;
- to Passengers who travel with a ticket bought at a fare available to the public.
Air Moldova is not responsible for or liable for failure to make connections or to operate any flight according to schedule or for a change to the schedule of any flight. Under no circumstances shall Air Moldova be liable for any indirect, consequential, incidental, punitive or special damages including, without limitation, damages for lost revenue or profits, loss of use, lost wages, or business interruption arising from the foregoing.
8.3 Delay
8.3.1 In accordance with the EU Regulation a delay occurs when a flight is delayed beyond its scheduled departure time by 3 hours for flights between 1.500 km and 3.500 km and by 2 hours for flights of up to 1.500 km. When Passenger’s flight is expected to have a long delay, Passengers are entitled to receive care while waiting. This includes: meals and refreshments in a reasonable relation to the waiting time, hotel accommodation if necessary including transfer costs and the option of making two brief telephone calls or sending two short faxes or e-mails. Care for Passengers while waiting may be declined if the provision of the care would itself cause further delay.
Air Moldova will make every effort to contact Passengers in advance by phone or e-mail if their flight is delayed or cancelled. Its passengers’ responsibility to leave right contact details while booking and ticket purchase.
Air Moldova will make an effort to contact Passengers in the event of a delay or cancellation. The Carrier recommends that Guests reconfirm their itineraries 24 hours prior to departure.
8.4 Cancellation
8.4.1 If Passenger’s flight, for which the Passenger holds a valid reservation, is cancelled, the Passenger is entitled to rebooking, re-routing, or refund without any additional charge.
8.5 Denied boarding
8.5.1 If in case of overbooking on a flight for which the Passenger holds a reservation, the Passenger is entitled either to an alternative flight or to rerouting, to the final destination at the earliest opportunity or to full refund of the unused flight segments and to compensation in accordance with the Carrier’s denied boarding compensation policy. The Passenger will receive a denied boarding compensation document (DBC) with the exact amount of the compensation.
8.5.2 The compensation shall be paid in cash at airline’s sales office located in Chisinau against DBC within 6 months from the date of such DBC issuance. Currency of payment is Moldovan Lei.
8.5.3 The Passenger may reroute his flight to the final destination at a later date (within 7 days after denied boarding). In this case the Passenger will have to pay the cost of food, accommodation and transfer.
8.5.4 These rights are not granted if the Passenger has been denied boarding on reasonable grounds, such as reasons of health, general or operational security, or inadequate travel documentation.
9. REFUNDS
The Ticket will be refunded, in whole or in part, in accordance with the applicable fare rules of Passenger’s Ticket.
The Carrier shall be entitled to make a refund either to the person named in the Ticket or to the person who paid for the ticket (sponsor whose name is indicated in the ticket), or upon presentation of satisfactory proof of such payment.
9.1 Involuntary Refunds
9.1.1 If the Carrier cancels a flight, fails to operate a flight according to schedule, fails to stop at destination or Stopover, or cause the Passenger to miss a connecting flight on which he holds a reservation, the amount of the refund shall be:
- for wholly unused ticket, an amount equal to the fare paid plus all unused airport taxes;
- for partially used ticket, the refund of unused part of the fare plus all unused airport fees and taxes.
9.2 Voluntary Refunds
9.2.1 If the Passenger is entitled to a refund of his ticket for reasons other than those set out in Article 9.1, the amount of the refund shall be:
- for wholly unused ticket, the fare paid, less penalty.
- Some tickets are sold at discounted fares, which may be completely non-refundable. Air Moldova representative or the authorized agent must inform the Passenger about the fare rules. Each Passenger should choose the fare best suited to his needs;
- Tickets sold at promo fares (booking class “P”) are non-refundable and non-changeable;
- for partially used ticket, the refund will be the difference between the fare paid and the applicable fare for travel between the points for which the Ticket has been used, less penalty.
9.3 The airline right to refuse refund
9.3.1 The Carrier may refuse a refund where application is made after the expiry of the validity of the ticket.
9.4 Manner of refund and currency
The ticket must be refunded in the currency used by its issue.
Refunds will be made by the Carrier or by its Authorized Agent, which originally issued the ticket.
10. CONDUCT ABOARD AIRCRAFT
10.1 General
If, in Carrier's reasonable opinion, Passenger conducts himself aboard the aircraft so as to endanger the aircraft, or any person or property on board, or obstructs the crew in the performance of their duties, or fails to comply with instruction of the crew, including, but not limited to those with respect to smoking, alcohol or drug consumption, or behaves in a manner which causes discomfort, inconvenience, damage or injury to other passengers or the crew, Carrier may take such measures as it deems reasonably necessary to prevent continuation of such conduct, including restraint. Passenger may be disembarked and refused onward carriage at any point, and may be prosecuted for offences committed on board the aircraft.
In case of emergency landing Passenger will be responsible to pay all resulting expenses incurred by the carrier.
10.2 Electronic Devices
10.2.1 For safety reasons, Carrier may forbid or limit operation aboard the aircraft of electronic equipment, including but not limited to cellular telephones, laptop computers, portable recorders, CD players, portable radios, electronic games or transmitting devices, radio controlled toys and walkie-talkies.
Operation of hearing aids and heart pacemakers is permitted.
10.2.2 Electronic equipment may interfere with the air navigation systems of the aircraft, therefore it is recommended to avoid their use during the flight.
10.2.3 Usage of electronic equipment during taxiing, takeoff and landing is strictly forbidden. Mobile phones must be switched off regardless of where they are - in baggage compartment or in hand luggage.
10.2.4 Smoking (including electronic- or other artificial forms of cigarettes) is strictly prohibited on board.
10.2.5 Recording videos and/or taking photographs other than personal videos and photographs is prohibited on board.
10.2.6 If a Passenger fails to comply with the Carrier’s provisions described above, the Carrier may take all the necessary measures, pursuant to legislative and regulatory provisions, in order to prevent such behavior.
11. ARRANGEMENTS FOR ADDITIONAL SERVICES
11.1 If Carrier makes arrangements for the Passenger with any third party to provide any services other than carriage by air, or issues a ticket or voucher relating to transportation or services (other than carriage by air) provided by a third party such as hotel reservations or car rental, in doing so Carrier acts only as the Passenger's agent. The terms and conditions of the third party service provider will apply.
11.2 In cases where Carrier does provide or operate ground transfer services between airports or between airports and town centers for its Passengers these Conditions shall also apply thereto.
12. ADMINISTRATIVE FORMALITIES
12.1 General
12.1.1 The Passenger is responsible for obtaining all required travel documents and for complying with all laws, regulations, orders, demands and travel requirements of countries to be flown from, into or through which he transits. Carrier shall not be liable for the consequences to any Passenger resulting from his or her failure to obtain such documents or visas or to comply with such laws, regulations, orders, demands and travel requirements, rules or instructions.
12.2 Travel Documents
12.2.1 The Passenger shall present all exit, entry, health and other documents required by laws, regulations, orders, demands or other requirements of the countries concerned and permit Carrier to take and retain copies thereof or otherwise to retain the data contained in the relevant documents.
Carrier reserves the rights to refuse carriage of any Passenger whose travel documents are not complete.
Carrier is not liable to the Passenger's failure to comply with the requirements of these Conditions of Carriage.
12.3 Refusal of Entry
12.3.1 The Passenger will be responsible to pay the applicable fare whenever Carrier, or Government order, is required to return a Passenger to his place of departure or elsewhere, owing to the Passenger's inadmissibility into a country, whether of transit or of destination.
12.3.2 At Carrier’s discretion Passenger may be asked to sign a notice regarding Passenger’s commitment to reimburse in full all the expenses for his transportation from the point of refusal or denied entry.
12.3.3 In case when a Passenger, who is denied entry into any country, does not compensate the Carrier for the cost of transportation from that country, has not signed the notice described in 12.3.2 and has purchased a new ticket for any Air Moldova flight, the Passenger will be accepted for transportation according to the new ticket without any additional expenses.
12.4 Passenger responsible for Fines, Detention Costs, etc.
12.4.1 If Carrier is required to pay or deposit any fine or penalty or to incur any expenditure by reason of Passenger's failure to comply with laws, regulations, orders, demands or other travel requirements or to produce the required documents, the Passenger shall on demand reimburse to Carrier any amount so paid or deposited and any expenditure so incurred.
Carrier may use towards such expenditure any funds paid to Carrier for unused carriage or any funds of the Passenger in the possession of Carrier.
12.5 Customs Inspection
If required, the Passenger shall attend inspection of his baggage checked and/or unchecked, by Customs and/or other Government officials. Carrier is not liable to the Passenger for any loss or damage suffered by the Passenger through failure to comply with this requirement.
12.6 Security Inspection
Passenger shall submit to any security control by Government or airport officials or by Carrier.
